On 27 March 2025, we held a webinar on greenwashing enforcement trends across the globe - in which we explored what regulators and stakeholders are challenging in the UK, EU, US, Asia and Australia, and how you can guard against the risks.
Key takeaways from the session:
- The risk of greenwashing (and related practices such as greenhushing) remains as present as ever. Appropriate governance structures are critical to avoiding risky practices and ensuring disclosures/claims can be substantiated to mitigate enforcement and litigation risk.
- A holistic strategy across geographies can help manage a global footprint – determine the strictest regime and take a centralised approach to avoid siloed thinking whilst managing divergent regimes and jurisdictions.
- Regulators and/or private litigants across the globe remain active in holding businesses to account where greenwashing is perceived to occur - enforcement trends in one market may spread to another, so cross-border scanning of greenwashing cases is a helpful tool to assess risk.
- Active engagement with relevant stakeholders can help mitigate the risk of formal action being taken and may offer a route for creative solutions.
