Directive (EU) 2024/1785 of the European Parliament and of the Council of 24 April 2024 amending Directive 2010/75/EU of the European Parliament and of the Council on industrial emissions (integrated pollution prevention and control) and Council Directive 1999/31/EC on the landfill of waste (usually referred to as the “Industrial Emissions Directive”) was published in the Official Journal of the EU on 15 July 202.
The Industrial Emissions Directive extends the scope of the existing Directive 2010/75/EU to industrial emissions from intensive poultry and pig farms, as well as from ore mines and large battery factories, provides for stricter emissions levels and emissions/environmental performance targets for covered sectors and requires Member States to impose penalties of up to at least 3% of operators' annual turnover in the EU for the most serious breaches. It also introduces, for the first time in EU environmental legislation, a right for citizens to claim compensation for damages to their health. The Commission’s initial proposal to reverse the burden of proof for such claims was not, however, supported by the co-legislators and was not included in the final text. The Industrial Emissions Directive will come into force on 4 August 2024. The Member States will need to transpose its provisions into national legislation by 1 July 2026.
