Energy Charter Treaty modernisation discussions underway

Discussions regarding potential modernisation of the Energy Charter Treaty, the most frequently invoked investment treaty in investor-State dispute settlement, are underway.  On 3-6 November 2020, the third round of discussions took place by video conference.

The "right to regulate", including in connection with environmental objectives, is a key area for discussion between the contracting parties.

The parties will take stock on any progress made to date by the end of this year, with further discussions to take place next year.
